Committee of Adjustment

/The Committee of Adjustment derives its jurisdiction from the Planning Act. Applications to the Committee are processed in accordance with the requirements of Section 45 and 53 of the Planning Act, applicable regulations (O.Reg. 200/96 and 197/96 as amended), the Statutory Powers Procedures Act and applicable Town policies.

The Committee is authorized by the Planning Act to consider applications for:

  • Minor variances from the provisions of the Zoning By-law;
  • Extensions, enlargements or variations of existing legal non-conforming uses under the Zoning By-law;
  • Land division (severing a new lot from an existing lot, adding land to an existing lot, easements, mortgages or leases in excess of 21 years);
  • Determining whether a particular use conforms with the provisions of the Zoning By-law where the uses of land, buildings or structures permitted in the by-law are defined in general terms.

Application forms for Consent (Land Severance) and Minor Variance are available.  Forms are also available from the Building and Planning Department located at the Libro Centre, 3295 Meloche Rd, Amherstburg, ON.

The Committee of Adjustment is comprised of five (5) appointed lay members from the community.

All consent and minor variance applications must be submitted to the Town a minimum of four weeks prior to the Committee of Adjustment meeting.

Speak at a Committee of Adjustment Meeting

Those seeking to attend meetings in-person should follow all public health guidance to ensure the safety of themselves and others.

Any person, who wishes to make representation electronically via the internet or telephone is required to register as a delegate using the link below.

Upon completion of the online delegation registration form, you will receive an automated email response that will provide registration instructions that can be used to gain access to the specified electronic Committee of Adjustment meeting.

If you have comments regarding an application, but are unable to participate in the Committee of Adjustment meeting, they may be forwarded in writing either by mail or in person to Janine Mastronardi, Secretary Treasurer, 3295 Meloche Road, Amherstburg, ON  N9V 2Y8.  Comments may be delivered in person at the Libro Centre.  Comments can also be emailed by 4:00 p.m. the Monday prior to the meeting to planning@amherstburg.ca. All public comments received prior to the meeting will be read aloud at the beginning of the relevant application.
